Requirements For Candidates For Regional Heads In The 2024 Regional Elections, Withdraw The Decision Of The Supreme Court With The Decision Of The Constitutional Court
Abstract
The formulation of the problem in this study is how the dynamics of the regulation of the age limit requirements for regional head candidates in the 2024 regional head elections. The purpose of this study is to find out the legal impact of the Constitutional Court decision No. 70/PUU-XXII/2024.This article is written using a type of normative legal study. The approach used in this writing is a statutory approach. The Constitution provides the basis that general elections for regional heads are held democratically. Article 18 Paragraph (4) of the 1945 Constitution states: "Governor, Regent and Mayor respectively as Heads of Provincial, Regency and City Regional Governments are elected democratically". Through Law Number 1 of 2015 concerning the Stipulation of Government Regulations in Lieu of Law Number 1 of 2014 concerning the Election of Governors, Regents and Mayors into Law, the election of regional heads, both Governors and Regents/Mayors, is elected directly by the community. The constitutional court, as the guardian of the constitution, intends, through the decision of the constitutional court, that the requirements for regional head candidates in the 2024 regional elections are regulated in Law Number 10 of 2016 or the Regional Election Law. This requirement was strengthened by the decision of the Constitutional Court regarding the calculation of the age of regional head candidates. Decision Number 70/PUU-XXII/2024 regulates that regional head and deputy candidates must be of the age that meets the candidacy requirements before being appointed as local election participants by the General Election Commission. This is stated in Article 15 PKPU No. 10 of 2024 that the minimum age requirement for regional head candidates is 30 (thirty) years for Candidates for Governor and Deputy Governor, and 25 (twenty five) years for Candidates for Regent and Deputy Regent or Candidates for Mayor and Deputy Mayor starting from the determination of the Candidate Pair
